With recent cases making their way into the headlines, including "L'affaire Bettencourt" and Mickey Rooney's conservatorship and US Senate testimony, this session will draw on experiences from litigators who can advise family wealth planners on key ways to avoid or minimise the chance of abuse. The discussion will include (a) typical fact patterns where financial abuse may happen or already be in progress, (b) the ethical dilemmas faced by lawyers in dealing with the affairs of clients whose mental capacity may be impaired and (c) cross-border issues of recognition and enforcement of protective measures, especially as between the US and the UK.
